Watchdog probes lawyer at centre of failed property deal

A LEGAL watchdog is investigating a complaint against a Midland solicitor after investors lost more than a million pounds on failed property deals in Egypt.

Phillip Morris, 45, from Kidderminster, Worcestershire, is under investigation by the Legal Complaints Service after investors complained that he had failed to tell them that property developer Andrew Harris was disqualified from being a company director in the UK.

Mr Morris is said to have acted as a go-between between investors and Mr Harris, from Hampton-in-Arden, Warwickshie, and angry investors say they were not told by the solicitor that the property developer was disqualified from being a company director. Mr Harris was disqualified as a director in 2005 for ten years.

The investigation into Mr Morris centres on property developments run by Harris through the Property Hotspots Worldwide firm in the Egyptian resort of Hurghada.

Investors have flocked to the Egyptian coast in recent years to purchase bargain overseas holiday homes and Hurghada has become increasingly popular with ex-pats, along with the nearby resort of Sharm-el-Sheikh.

The Sunday Mercury has received complaints from at least 10 investors from Britain, Sweden, Poland, the Netherlands and the USA, angry at Mr Morris for failing to inform them of Mr Harris’ status as a disqualified director.

The investors, who have each paid between £20,000 and £100,000 for properties in the Regency Towers and Regency Continental projects, say they paid Property Hotspots Worldwide through Mr Morris, and have now been told that the land belongs to an Egyptian landlord.

Angry that their investments are worthless they are seeking compensation from Mr Morris and claim they have been the victims of a rip off.

A spokesman for the Legal Complaints service said: “We received a complaint on 14 May and it is being handled by our casework team.

“We have set out the background to the complaint and we are in the first phase of investigation.

“If there is a breach of the solicitors code of conduct the matter will be referred to the Solicitors Regulatory Authority (SRA).”

Mr Morris has been a director of Legal Alliances Worldwide, based in Kidderminster, since 2008, and has been a qualified solicitor for almost 20 years.

Misconduct

A spokesman for the SRA said last night: “At the moment each complaint will be dealt with separately by the LCS to determine the appropriate level of compensation if there has been wrongdoing.

“If they uncover evidence of misconduct that would require an investigation by us then that will take place straight away.

“This is not an either or situation, compensation may be awarded by the LCS and we can then take action including striking off a solicitor.”

Last night a spokeswoman for Mr Morris’ law firm said: “We can confirm that we are instructed to act on behalf of a number of buyers on the Regency Towers and Regency Continental developments in Hurghada, Egypt.

“We wish to make it absolutely clear that all monies received from the clients for their property purchases were transferred to the developer pursuant to their contract of sale and upon our client’s instructions.

“We refute entirely any suggestions that Legal Alliances Worldwide has retained purchase monies paid by its clients.

“We cannot comment on any investigations by either the Legal Complaints Service or the SRA as it would be inappropriate to do so. We acted at all times with independence, honesty and good faith.”

Andrew Harris previously supplied holiday homes to Somerville Leisure, which was wound up by the Department of Trade and Industry in 2001 following an investigation into dodgy holiday deals. Mr Harris has agreed to meet with our reporter this week to discuss the Hurghada property fiasco. He claims he has personally lost money on the deal, and that he has been scammed by the Egyptian landlord who agreed to sell him the property."

I recently sent out an email to a few people who had been victim of Philip Morris on World Wide Destinations developments namely Desert Pearl 1, 2 and Coral Sea pearl with interest of taking joint negligence action against morris the crook. Unfortunately I had very little response and there was only 2 or 3 who was keen to pursue. We will need a few more people to make it affordable for us all. If we have to pay full price to bring him to justice the total cost may be around £30000. Obviously we are looking to get a no win no fee lawyer, but as soon as any lawyer see a very small group they will not even consider it. So evryone please email we need lot more than 3. please email morrislaw@hotmail.co.uk without delay. I know like me one or 2 are considering swap to pyramids beach with Neil Hollingsworth and even then it still is worthwhile as we can reclaim 3 years loss odf rent, stress etc cused by morris the crook

For some time now we have been continuing our enquiries with Egypt Advocates to see if there is some legal redress available to you against what we consider the fraudulent activity of Mr. Adley in not handing over your apartment. Those enquiries have included ongoing canvassing of the agents in Egypt to ascertain whether this development has in any way been put up for re-sale which would be evidence of Mr. Adley conducting business in a commercial manner. You may recall that this legal point was necessary due to the fact that we only obtained a copy of the original contract between Mr. Harris and Mr. Adley (taken from the original) as part of the due diligence but for court proceedings to be issued in the civil courts they require the original. Despite all of our efforts with Mr. Harris the original was never provided to us. Alternatively, if we could show that Mr. Adley was acting in a commercial manner then the original is not required. Our investigations did not reveal any company registered with Mr. Adley therefore the only other evidence would be to show he was re-selling RC1. To date we have only received rumours but no concrete evidence.



We appreciate that time is marching on and are therefore considering another alternative which is to refer the matter to the Public Prosecutor to investigate. The PP has the power to order Mr. Adley to hand over the apartments to the buyers if he finds on the evidence that they have properly paid and that Mr. Adley has received the monies due from Mr. Harris. As previously reported to you, Mr. Adley admitted in a meeting before witnesses that the only amount due was equivalent to £27,000, however, he added interest to this amount and increased it to around £45,000. Mr. Harris defended his position by saying that the final payment to Mr. Adley was withheld until Mr. Adley had completed the connections of the government utilities for water and electricity. This seemed a reasonable approach in order to safeguard Mr. Adley fulfilling his final obligations but as you know Mr. Adley’s response was to change the locks on the front entrance and seize the building and refuse to hand over any of the apartments. Mr. Adley has continued to ignore the buyer’s rights.



Egypt Advocates are proposing that the matter now be referred to the Public Prosecutor to try and bring this matter to the attention of the authorities and put this matter right. You will see from the attached copy e-mails from Egypt Advocates that essentially they are saying that the proceedings before the PP will take approximately 3-6 months at a cost of £500 to include all disbursements to the PP’s office for referring the claims for all of our clients. There will be a great deal of evidence to prepare. However, I note that under Egyptian law the Lawyer is entitled to a “rescue fee” of 20% of the purchase price for each apartment “rescued”. Egypt Advocates initially said that they will deduct from their 20% fee the expenses they incur for the proceedings with the PP. We have informed Egypt Advocates that 20% is too much. They have finally agreed to reduce this to 10% of the purchase price. The fee is only payable in the event that they succeed in recovering your apartment therefore the only fee payable now would be the £500 to include for the PP fees.



As with all matters referred to the courts and other authorities there are no guarantees that the referral to the PP will be successful but if not the PP has the power to refer the case to the civil or commercial courtsif the buyers wish to continue with the matter. Egypt Advocates have set out what the time frame for that will be but it is not clear whether you would have to make any additional payment for expenses above the £500 if the matter is referred to the courts. We expect that there would be. Our view is that you should consider referring the matter to the PP only at this stage on the basis that spending £500 to try and recover the full cost of your purchase is worth the risk.



We have no financial interest in the proposal put forward by Egypt Advocates and will take no fee. Nevertheless, we are fully aware of the wrong that has been done here and will provide all reasonable help to assist in this wrong being put right. Mr. Osman will need our help perhaps in respect of providing evidence to the PP of your purchase such as proof of payments to Mr. Harris. We shall provide such help without charge to you but you will need to confirm your consent in writing for us to disclose information about your purchase to Egypt Advocates. We are forwarding the proposal received from Egypt Advocates to you for your consideration and this letter is intended only to provide further guidance not advise. The decision to proceed must be based on your considerations and financial circumstances.



If you wish to proceed you will need to wire the £500 directly to the account of Egypt Advocates. The bank details are as follows:
